The primary purpose of all the facilities and equipment owned by the LCCTC and its Authority is to provide instruction for youth and adults; therefore, priority for the use of all facilities and equipment will be given to the instructional program and its necessary support. Rental of facilities and equipment for community purposes may be permitted when such use does not interfere with, or cause alteration of, the instructional program.
The Joint Operating Committee may grant permission to use school facilities and equipment for community purposes when permission has been requested in writing at least thirty (30) days prior to the date sought for such use and has been recommended for approval by the administration. The Joint Operating Committee reserves the right to approve or deny any such requests, and/or amend the rules and regulations for rentals. The Executive Director and/or Business Manager shall develop guidelines for granting permission to use the school facilities and shall promulgate rules and regulations for such use.
The JOC prohibits use of school facilities for the following activities:
Partisan political activity,
Advocacy or promotion of a philosophy which would provide a threat to the health, safety or welfare of students or staff, or if such use could bring danger to school facilities, or
Any purpose which is prohibited by law, or
Otherwise interfere with LCCTC educational programs.
For purposes of this policy, the LCCTC shall include the Joint Operating Committee, the LCCTC and all of their respective employees, officers, directors and agents. The LCCTC is not liable for the quality or performance of facilities or services. In addition, the LCCTC shall not be liable to tenants or tenant's agents, employees, contractors, invitees, customers, concessionaires, licensees or any other occupant of the premises, and the tenant shall hold the LCCTC and its agents, employees and trustees harmless and will defend and indemnify the LCCTC from any loss, cost, liability, claim damage (including attorney's fees and disbursements), penalty or fine incurred arising from any injury to any occupant or damage/loss of personal property of any occupant. Tenant shall also pay all costs, including reasonable attorney's fees that may be expended or incurred by the LCCTC in enforcing this Agreement. A Certificate of Liability Insurance in an amount set forth from time to time by the Joint Operating Committee is required and must be forwarded to the School Business Office prior to using the facility; however, organizations may request a waiver of this insurance requirement.
The following general regulations will apply to all organizations using the school facilities:
Any contracted services shall be performed in compliance with all LCCTC directives regarding the use of facilities and/or school equipment.
Any school equipment that may be used in conjunction with requested facilities shall be identified at the time that the requests for use of facilities is made. The users of school equipment must accept liability for any damage or loss to such equipment that occurs while it is in their use. A qualified operator is required to use any equipment.
Nothing may be attached to floors or walls by means of screws, nails, etc. All props, etc. must comply with Department of Labor and Industry regulations. Advertising signs are not permitted. All property of the renter must be removed from the school immediately following the activity.
The tenant shall agree to comply with this policy.
All groups renting a school facility and having the facility open to the general public may be required to have a minimum of two (2) police officers for the purpose of maintaining crowd control and for handling traffic problems as deemed necessary by LCCTC. The LCCTC will contract with a security provider and the group shall be required to pay the cost of protection. The administration may require that the group employ the services of more than two (2) police officers if deemed appropriate for the event and/or meeting.
Parking of vehicles is prohibited in the fire lanes and other unauthorized areas marked with yellow curbing and/or signs. The Local Police are authorized to charge persons who illegally park their vehicles.
Smoking and the use of alcoholic beverages are prohibited on school property.
The Joint Operating Committee shall establish annually a schedule of fees for the use of school facilities.
Amounts paid by the agency shall equal or exceed the necessary costs for providing the service.
The renter shall be obligated to pay for the services of custodians and other school personnel required to operate the rented facility or provide other services. Such personnel charges shall be included in the rental charge for the use of facilities.
Rents are due and payable within thirty (30) days after billing. All checks are to be made payable to the "Lancaster County Career & Technology Center" and mailed to the attention of the Business Office, Lancaster County Career & Technology Center, 1730 Hans Herr Drive, Willow Street, PA 17584
There shall be no charge for the use of the auditorium, cafeteria and classrooms for educational activities connected with the LCCTC; however, there may be rental charges for the use of other school facilities for educationally related activities.
Any funds received pursuant to this policy shall be accounted for in the appropriate fund of the LCCTC.
Use of Facilities by Member School Districts
Permission may be granted for member districts to use the school facilities at no charge, provided that the service performed is not used for profit or sales by the participating district. Costs incurred because of use of equipment and/or facilities shall be paid by the participating district, exclusive of depreciation and ordinary operating/maintenance costs. Any group other than those connected with the school's educational program may rent the building at the existing rates established by the Joint Operating Committee.
