The following Federal Acquisition Regulations and Department of Defense FAR Supplements are incorporated into this Purchase Order as required to be flowed down by prime contract number
52.232-17 Interest (JUN 1996)
Flowdown is not expressly required by the clause; however it should be included in subcontracts which contain FAR clauses which expressly refer to an Interest clause, e.g. fixed price incentive subcontracts containing FAR 52.216-16 or FAR 52.216-17.
252.211-7003 Item Identification and Valuation (Jan 2004)
Paragraph (h) of this clause requires that the requirements of the clause be included in all subcontracts that will result in delivery under the prime contract of subassemblies, components, and parts embedded within certain identified items listed in the applicable prime contract. For some types of subcontracts, marking may be more efficiently performed by Lockheed Martin. In lieu of including this clause in subcontracts, the requirements of this clause may be included in the technical provisions of the subcontract, such as the statement of work.
252.225-7004 Reporting of Contract Performance Outside the United States (Apr 2003)
Paragraph (c) expressly requires the clause to be included in all first tier subcontracts exceeding $500,000, except subcontracts for commercial items, construction, ores, natural gases, utilities, petroleum products and crudes, timber (logs), or subsistence. If Lockheed Martin is a subcontractor to another prime contractor, the clause does not need to be included in second-tier subcontracts.
252.225-7012 Preference for Certain Domestic Commodities (May 2004)
While the clause does not expressly require flowdown, it must be included in subcontracts to ensure Lockheed Martin does not deliver items prohibited under the prime contract.
252.225-7013 Duty-Free Entry (Jan 2005)
Paragraph (g) expressly requires that the clause be included in all subcontracts for:
(i) Qualifying country components; or
(ii) Nonqualifying country components for which the Contractor estimates that duty will exceed $200 per unit.
252.225-7025 Restriction on Acquisition of Forgings (Jun 1997)
Paragraph (e) expressly requires the clause to be included in all subcontracts that are for items containing restricted forging items.
252.232-7004 DoD Progress Payment Rates (Oct 2001)
While the clause does not expressly require flowdown, either the clause should be included in all subcontracts providing progress payments, or the progress payments clause should be modified to include the proper rates. Note that subcontracts with small business concerns and small disadvantaged business concerns are eligible for a higher progress payment rates than large business concerns.
252.243-7002 Requests for Equitable Adjustment (Mar 1998)
While flowdown of the clause is not required, the clause may be included in subcontracts over $100,000
252.246-7000 Material Inspection and Receiving Report (Mar 2003)
Flowdown is not expressly required by the clause, but it should be included in all subcontracts that authorize direct shipments by the subcontractor to the Government.
