DEMANDE D’OUVRAGES ET DE DONNÉES DE RÉFÉRENCE

1. Très nombreux sont ceux qui, au cours des dernières années, se sont inquiétés du fait que des brevets ont été délivrés pour certaines inventions qui ne remplissaient pas les conditions fondamentales pour pouvoir être brevetées en relation avec les savoirs traditionnels dont découlaient ces inventions. Ces savoirs traditionnels auraient pu, si les examinateurs de brevets en avaient eu connaissance au moment de procéder à l’examen des demandes, être considérés comme faisant partie de l’état de la technique et auraient pu être opposés à toute affirmation selon laquelle l’invention répondait au critère de nouveauté ou d’activité inventive et était donc brevetable.


2. Par exemple, un brevet relatif à l’utilisation du safran pour guérir des blessures a été révoqué une fois que l’invention brevetée a été comparée avec des documents indiens anciens qui attestaient que l’invention ne répondait ni à l’exigence de nouveauté ni à l’exigence d’invention.
3. À la suite des nombreuses propositions reposant sur l’idée que la place occupée par les savoirs traditionnels dans l’état de la technique se trouverait considérablement renforcée si les examinateurs de brevets avaient accès aux savoirs traditionnels existants dûment documentés, le Secrétariat de l’Organisation Mondiale de la Propriété Intellectuelle (OMPI), dans le cadre du programme d’activités exécuté en relation avec le Comité intergouvernemental de la propriété intellectuelle relative aux ressources génétiques, aux savoirs traditionnels et au folklore, s’emploie actuellement à réaliser deux inventaires qui pourraient constituer une référence utile en vue d’empêcher la délivrance de brevets portant sur des savoirs traditionnels divulgués :
a) un inventaire des périodiques, des revues ou des gazettes existants relatifs aux questions liées aux savoirs traditionnels; et

b) un inventaire des bases de données en ligne existantes relatives aux savoirs traditionnels.


4. Ces inventaires ne contiendront que des informations relatives à des publications et à des bases de données touchant aux savoirs traditionnels qui sont déjà dans le domaine public. Leur objectif est de contribuer à empêcher la délivrance de brevets portant sur ces savoirs. L’OMPI n’a pas répertorié, et ne souhaite pas répertorier, les savoirs traditionnels en tant que tels.
5. Le Secrétariat de l’OMPI souhaite obtenir des contributions qui l’aideraient à réaliser ces inventaires. Parmi les catégories de savoirs traditionnels pertinentes figurent : les savoirs médicinaux, y compris les médicaments et les remèdes connexes; les savoirs agricoles; les savoirs scientifiques et les savoirs techniques. Le Secrétariat souhaiterait en particulier recevoir des informations sur des publications et des bases de données nationales ayant trait aux savoirs traditionnels qui ont été constituées par des collectivités locales et des peuples autochtones ou avec le consentement préalable de ceux ci donné en connaissance de cause.

8. L’OMPI souhaiterait recevoir les éléments d’information ci après sur les bases de données en ligne relatives aux savoirs traditionnels :

d) Nom et coordonnées du ou des compilateurs de la base de données (particulier(s), organismes, communautés, etc.)

e) Nom et coordonnées de l’éditeur ou des éditeurs de la base de données

f) Taille approximative de la base de données (c’est à dire nombre d’entrées)

g) Langue de la base de données

  • http://www.taiga.net/webdata/aklaviktk/ – Base de données sur les savoirs traditionnels répertoriés du Yukon North Slope;

  • http://www.nativeknowledge.org Base de données sur les savoirs traditionnels et les aliments originaires de l’Alaska;

  • http://www.umd.umich.edu/cgi-bin/herb – Base de données sur l’ethnobotanique amérindienne constituée par l’Université du Michigan – Dearborn; et

  • http://ip.aaas.org/tekindex.nsf – TEKPAD (base de données sur l’état de la technique en matière de savoirs traditionnels relatifs à l’environnement).

Les inventaires seront également publiés sur le site Web de l’OMPI à l’adresse : www.wipo.int.
