ASBESTOS LICENCE CONDITIONS (Standard)

Condition

This licence or a copy thereof, should be made available by the licensee for inspection at the request of any person to whom the licensee submits a tender or quotation for work with asbestos and shall be available for inspection at all work sites. A copy of the licence shall accompany each notification required by Condition 2.

The licensee shall give notice in writing of the work to the appropriate HSE or local authority office at least 14 days before the work is commenced, or such other period as the authority will allow. The notice shall specify the type of work to be carried out, the likely duration of the work, the address of the premises at which the work is to be carried out and the date of commencement of the work activity. The enforcing authority must be informed in writing as soon as possible if this information changes. This condition will only apply to licensable work with asbestos as defined in Regulation 2 of the Control of Asbestos Regulations 2012 or when the licensee hires out employees (at operative level) to other licensees.

(a) Prior to submitting the notice of work required by Condition 2 the following documents shall be prepared by the licence holder:
i) a suitable and sufficient written statement of the plan of work to be used.
ii) a suitable and sufficient written specification for the equipment for the protection and decontamination of those engaged in asbestos work and also for the protection of other persons, as appropriate to the work.
(b) The licensee shall, on request by HSE and/or the local authority provide copies of the documents referred to in 3(a) and/or allow inspection of those documents as required.
(c) Work carried out under the notice of work required by Condition 2 shall be carried out in accordance with the suitable and sufficient plan of work and the equipment, as specified in (a) (i) and (ii).
The plan of work and written specification must be provided on request and be available at the time of notification.

This licence shall only apply to work with asbestos carried out with another licence holder and shall be restricted to directly supervising the licensable work.

Before work under the terms of this licence is carried out for the first time, a copy of the notice required at condition 2 shall also be given, at the same time, to the Asbestos Licensing Principal Inspector at the xxxx office of the Health and Safety Executive.

Before work under the terms of this licence is carried out for the first time, written agreement must be obtained from the Asbestos Licensing Principal Inspector at the xxxx office of the Health and Safety Executive.

This licence shall only apply to putting up and taking down scaffolding, including any scaffolded frame, to provide access for licensable work where it is foreseeable that the scaffolding activity is likely to disturb the asbestos.

Before work under the terms of this licence is carried out for the first time, a copy of the most recent medical certificates, training certificates and evidence of face-fit testing for respiratory protective equipment (RPE) in respect of persons undertaking the work shall be provided to the Asbestos Licensing Principal Inspector at the xxxx office of the Health and Safety Executive.

Personal monitoring shall be carried out at every job, until otherwise agreed in writing by the Asbestos Licensing Principal Inspector at the xxxx office of the Health and Safety Executive, that sufficient information has been accumulated to allow a reduction of monitoring at representative jobs only.

This licence shall only apply to work with asbestos prior to demolition or dismantling operations.

Work with asbestos shall be personally supervised by a senior member of management whose name shall be specified when notice is given in accordance with Condition 2 above.

The notification in Condition 2 shall include the name of all persons who will be carrying out the work. A further notification shall be made of any subsequent change of personnel.

In addition to the company's health and safety arrangements, as required by Regulation 5 of the Management of Health and Safety at Work Regulations 1999, an auditing system, carried out by a competent, independent person, unrelated to the licensee and as agreed with the Asbestos Licensing Principal Inspector (ALPI) at the XXXX office of the Health and Safety Executive, should be instituted. Such auditing should cover XX% of the notifications submitted annually by the licensee under the Control of Asbestos Regulations 2012. The results from the audits should be reviewed, recorded and required actions implemented every 3 months. A report of the review, summarising findings, should be submitted to the above ALPI every 3 months until agreement is reached with the said ALPI that the practice should cease.

The licence is valid only for work with asbestos when such work is ancillary to the repair dismantling or removal of electric storage heaters.

All work with asbestos for which this licence is required by Regulation 2 of the Control of Asbestos Regulations 2012 shall be personally supervised by xxxx.

This licence shall be limited to the maintenance of air extraction equipment at the premises (insert full site address).

A copy of the notice required at Condition 2 shall also be given at the same time, to the ALPI at the xxxx office of the Health and Safety Executive.

Work with asbestos shall be restricted to work on or in connection with contaminated land.

Before work under the terms of this licence is carried out for the first time, a copy of Employer’s Liability Compulsory Insurance (ELCI) shall be provided to the Asbestos Licensing Principal Inspector at the xxxx office of the Health and Safety Executive.

Whenever any of your employees are hired out to other asbestos licence holders, you must supply the following information to the Asbestos Licensing Principal Inspector at the xxxx HSE office on a 3-monthly frequency, retrospectively: the name and address of the other contractor(s), employees’ names, date of commencement and duration of hire term.

The licensee shall give notice, in writing, of the work carried out at the premises in condition 19, to the appropriate HSE or local authority office on receipt of this licence. The notice shall specify the type of work to be carried out. The enforcing authority must be informed in writing as soon as possible if this information changes. This condition will only apply to licensable work with asbestos as defined in Regulation 2 of the Control of Asbestos Regulations 2012.

The notice of work required by Condition 2 above shall include:
a) a suitable and sufficient written statement of the plan of work to be used;
b) a suitable and sufficient written specification for the equipment for the protection and decontamination of those engaged in asbestos work and also for the protection of other persons, as appropriate to your work.
