Erection of a block of 6 lock-up garages and one additional lock-up garage to existing block.

29 CORNWALL PLACE, BLACKPOOL, FY3 9NR


Decision: Grant Permission
Conditions

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.



Reason: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990 (as amended).
2. The development shall be carried out in accordance with the plans, drawings and details hereby approved, unless prior written agreement is given by the Council as Local Planning Authority to any slight variation.

Reason: To ensure the development proceeds in compliance with this permission.
3. Details of materials to be used on the external elevations shall be submitted to and agreed in writing by the Local Planning Authority prior to any work commencing on the construction of the two garages nearest to Cornwall Place

Reason: In the interests of the appearance of the locality, in accordance with Policy LQ4 of the Blackpool Local Plan 2001-2016.
4. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) the garages shall not be used for any purposes which would preclude their use for the parking of motor cars or for domestic storage, and in particular shall not be used for commercial purposes.

Reason: In the interests of residential amenity, in accordance with Policies BH3 and LQ1 of the Blackpool Local Plan 2001-2016.
5. Before any work is commenced on the construction of the two garages nearest to Cornwall Place a desk study shall be undertaken and agreed in writing with the Local Planning Authority to investigate and produce an assessment of the risk of the potential for on site contamination. If the desk study identifies potential contamination, a detailed site investigation shall be carried out in accordance with a written methodology, which shall first have been agreed in writing with the Local Planning Authority. If remediation methods are then considered necessary, a scheme for decontamination of the site shall be submitted to and approved by the Local Planning Authority. The approved scheme shall be implemented and completed prior to the commencement of work on the two garages nearest to Cornwall Place. Any changes to the approved scheme shall be agreed in writing with the Local Planning Authority.

Reason: To ensure a safe form of development that poses no unacceptable risk of pollution to water resources or to human health and in accordance with Policy BH4 of the Blackpool Local Plan 2001-2016.
6. The development hereby approved shall incorporate appropriate and comprehensive construction designs to alleviate the possibility of landfill gas ingress to the building. Such measures shall conform to the advice given in Approved Document C of the Building Regulations 2000 (as amended) and Building Research Establishment Reports 211 and 212 (both 1991) and shall be agreed in writing with the Local Planning Authority prior to any work taking place on the construction of the two garages nearest to Cornwall Place.

Reason: To accord with the requirements of the Environment Agency in accordance with Policy BH4 of the Blackpool Local Plan 2001-2016.
7. Prior to any work taking place on the construction of the two garages nearest to Cornwall Place, the shed shown on the submitted plan shall be removed and the land thereafter retained as manoeuvring space.

Reason: For the avoidance of doubt and in order to retain satisfactory access to the garages, in accordance with Policy AS1 of the Blackpool Local Plan 2001-2016.
8. Before any work is commenced on the completion of the four garages and the construction of the two garages nearest to Cornwall Place details of the drainage for the roofs of the garages and the forecourt area to the garages shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented as part of the development and shall be operational before any of the approved garages are brought into use

Reason: To safeguard the amenities of neighbouring residents and in accordance with Policies BH3 and BH4 of the Blackpool Local Plan 2001-2016
REASONS FOR THE DECISION: The proposal has been considered in relation to Policies BH3, BH4, AS1, LQ1 and LQ14 of the Blackpool Local Plan 2001- 2016 and is in accordance with those policies and there are no other material considerations which weigh sufficiently against the proposal such as to warrant refusal.
