Earlier this month, petitioners’ attorney contacted the County Highway Department regarding the possibility of interference with the vision setback at Musket Drive and Taino Way. The triangular vision setback is specified in the UZO as “measured along the curbs of the 2 intersecting streets…The distance from the corner of the intersection shall be 40’ in each direction; a diagonal connecting those two 40’ line segments closes the triangle” (UZO 4-4-7(a)) The Highway Department confirmed that there is no interference with vision at this intersection.

Staff’s objection to petitioners’ request has never been the vision triangle; in fact, staff checked the vision setback triangle when petitioners first filed their request and found that the home, even in violation of the required setbacks, does not interfere with vision at the corner.

Staff’s primary clear vision concern with this request is that residents of the house yet to be built to the north on Musket Drive, located on a cul-de-sac, will encounter two problems with petitioners’ home:



  1. They will have a more difficult time seeing when backing out of the driveway; and

  2. Will have to back out farther before they are able to see if anyone is on the sidewalk.

Even though there is no interference with vision at the intersection of Musket Way and Taino Drive, staff cannot recommend approval of this request.

RECOMMENDATION:

Denial
