ORDINANCE 170 AN ORDINANCE RELATING TO THE ADMINISTRATION AND CHARGES FOR THE USE OF THE WASTE GATHERING AND TREATMENT FACILITES The City Council of the City of Bird Island ordains:
Section I. CHARGES FOR SEWER SERVICES
Subdivision 1. There shall be and there is hereby established a sewer charge for the service supplied by the sewer and waste treatment system of the City of Bird Island in the amount of fifty-five cents ($.55) per thousand (1000) gallons of water used, as indicated by quarterly water meter reading and calculation. This service charge may from this day forward, be set by the City Council by resolution and may be changed as necessary in the same manner.
Subdivision 2. Billing for this charge shall be included with the quarterly billing for the city water services. Such billing shall be due at the end of 3 months, at which time a 10% late penalty will be assessed to any unpaid accounts. Meters shall be read 4 times per year in 3 month increments.
Subdivision 3. Those water patrons subject to the minimum city water service billing shall be charged a minimum sewer charge of $1.38 per quarter. This charge may also be set by resolution and changed as necessary in the same manner.
SECTION II. EXCEPTIONS
Subdivision. 1. Any water patron whose premises are not connected to the sewer system of the city shall be exempt from the sewer service charge, excepting rural water users, who will be charged the residential sewer rate in lieu of higher water rates.
Subdivision 2. Any water patron, who as deemed by the Bird Island City Council, creates a greater demand on the sanitary sewer and waste treatment system that normal water patrons, can be subject after a hearing on such surcharge.
SECTION III. LIABILITY
The owner of the premises served and the occupant thereof and the user of these sanitary sewer services shall be jointly and severally liable for the sewer service charges and subject to all conditions and penalties as set forth in the water service ordinance.
SECTION IV. ADMINISTRATION AND DESIGNATION OF FUNDS
Subdivision 1. It is hereby made the duty of the City Clerk to render bills for sewer services and all other charges in connection therewith and to collect all money due therefrom.
Subdivision 2. All revenues derived from these sewer service fees shall be used only for Council authorized expenditures necessary to the operation of the sewer system or waste treatment facilities, with the exception of five cents ($.05) per thousand (1000) gallons of water. These monies shall be placed in a Capital Improvement Fund and used only for major improvements to the system.
SECTION V. COLLECTION POLICY
Subdivision 1. The collection of delinquent sewer bills shall be the same as water bills, stated in Resolution 151, allowing shut off of water services on any accounts 4 months old, with a 10 day grace period.
Subdivision 2. Resolution 169 allows any accounts 4 months delinquent to be certified to the County Auditor for collection with property taxes.
SECTION VI. REPEAL
Ordinances 97 and 156 and all other provisions of ordinances inconsistent with this ordinance are hereby repealed.
SECTION VII. EFFECTIVE DATE
This ordinance becomes effective upon its passage and publications according to law.
