AN ACT relating to school calendars and declaring an emergency.
Be it enacted by the General Assembly of the Commonwealth of Kentucky:
Section 1. (1) A local board of education of a district that missed twenty (20) or more instructional days during the 2009-2010 school year due to illness, inclement weather, weather related emergencies, or local disasters that endangered the health and safety of children may request the commissioner of education to waive the makeup of instructional days missed beyond twenty (20) days. The district may request waiver of up to a maximum of ten (10) days, including waiver of makeup days beyond twenty (20) days scheduled in the district's approved calendar.
(2) The commissioner shall inform local boards of education of the procedures to be used when making a request for a waiver of instructional days under this section.
(3) (a) A local board of education shall submit an amended calendar for the 2009-2010 school year to the commissioner of education no later than May 1, 2010, and shall include a request for the waiver of instructional days as approved by the local board.
(b) Notwithstanding any other statute or administrative regulation to the contrary or any other provision of 2008 Ky. Acts ch. 127, the commissioner shall approve a request for up to ten (10) instructional days as requested by a local board that has missed twenty (20) or more instructional days during the 2009-2010 school year.
(4) School district certified and classified personnel shall make up any student instructional days waived by participating in instructional activities or professional development or by being assigned additional work responsibilities.
Section 2. Whereas school districts must plan immediately how to amend the calendar for instructional days missed during the 2009-2010 school year, an emergency is declared to exist, and this Act takes effect upon its passage and approval by the Governor or upon its otherwise becoming a law.
